By using FanSwype, you agree to these Terms of Service.

1. The Service

FanSwype is an entertainment ranking application that lets you rank episodes and films from popular franchises using a head-to-head comparison system, with personalised rankings, global community rankings, and the ability to compare with other users.

2. User Accounts

No email or password is required. We use anonymous device-level authentication.
You choose a display name (max 20 characters) and avatar during setup.
Profanity and offensive names are filtered. We reserve the right to reset display names that violate community standards.

3. In-App Purchases

FanSwype offers non-consumable in-app purchases that unlock additional franchises and features.
Purchases are processed through the Apple App Store or Google Play Store.
Refunds are handled by Apple or Google per their respective refund policies.
You can restore purchases on a new device via Profile > Restore Purchases.

4. Advertisements

Free-tier users see banner advertisements and periodic full-screen interstitial advertisements.
Ads are served by Google AdMob. Non-personalised by default; personalised only with your explicit consent.

5. Intellectual Property

FanSwype is an independently created application developed by FanSwype, Australia. All moral rights in the application, including its design, code, structure, and original creative elements, are asserted under the Copyright Act 1968 (Cth).

The visual assets used within FanSwype are original works generated using artificial intelligence. They are independently created images intended to evoke the general aesthetic of popular film and television franchises without reproducing any copyrighted artwork, trademarked logos, character likenesses, or other protected visual elements. No passing off is intended or implied.

Franchise names, film titles, and episode titles are used solely in a referential and nominative capacity to identify the works being discussed. Their use does not imply any affiliation with, endorsement by, or licence from the relevant rights holders.

FanSwype is not affiliated with, endorsed by, or in any way officially connected to any franchise, studio, network, or rights holder referenced within the application.

FanSwype was created by fans, for fans. Our visual style is a loving homage to the franchises we celebrate. All images are independently created AI-generated works.

By using FanSwype, you acknowledge the following:

You are engaging with fan-generated rankings, not official content.
All intellectual property rights in franchise names, titles, and associated marks remain with their respective owners.
No licence is claimed or implied over any franchise name or trademark.

6. User Content

User-generated content is limited to display names only.
There is no messaging, chat, or user-generated media functionality.
Rankings and votes are your personal data and can be deleted by deleting your profile.

7. Acceptable Use

You agree not to:

Use the app for any unlawful purpose.
Attempt to reverse-engineer, decompile, or extract source code.
Interfere with the app's operation or other users' experience.
Create accounts for the purpose of abuse, spam, or manipulation of rankings.

8. Disclaimer

The app is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or error-free operation. Rankings are generated by user votes and do not represent any official or authoritative ranking.

9. Limitation of Liability

To the maximum extent permitted by law, FanSwype shall not be liable for any indirect, incidental, or consequential damages arising from use of the app.

10. Governing Law

These Terms are governed by the laws of Australia.

11. Changes

We may update these Terms. Continued use after changes constitutes acceptance.
