These Terms of Service ("Terms") govern your use of the FanSwype mobile application ("App") operated by FanSwype ("we", "us", "our"). By using the App, you agree to these Terms.

1. The Service

FanSwype is an entertainment ranking app that lets you rank films and TV episodes from popular franchises using a swipe-based comparison system. The App provides personalised rankings, global community rankings, and the ability to compare rankings with other users.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

3. User Accounts

• Accounts are created anonymously using a device-level identifier. No email, password, or personal information is required.
• You are responsible for maintaining the security of your device and account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

You agree not to:

• Use offensive, abusive, or profane language in your display name
• Attempt to interfere with, compromise, or disrupt the App or its infrastructure
• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Impersonate another person or entity

5. Content and Intellectual Property

• Franchise content: All film and TV episode titles, descriptions, and associated metadata are used for informational and commentary purposes under fair use / fair dealing principles. All trademarks and copyrights remain the property of their respective owners.
• Episode images: Promotional images are used for identification purposes within the ranking system.
• App content: The App's design, code, ranking algorithms, aggregated rankings, statistical analyses, and all other original content are owned by FanSwype and protected by intellectual property laws.
• User contributions: By using the App, you grant FanSwype a perpetual, irrevocable, worldwide, royalty-free licence to use, aggregate, and derive insights from your votes and rankings in de-identified, aggregated form. Individual votes cannot be traced back to you.

6. In-App Purchases

• The App offers optional paid unlocks to access additional franchises.
• Pricing: Individual franchise unlock or all-franchise bundle, as displayed in the App.
• Payment: All purchases are processed by Apple (App Store) or Google (Google Play) according to their respective terms.
• Refunds: Refund requests must be directed to Apple or Google, as applicable, in accordance with their refund policies.
• No guarantee of availability: We reserve the right to modify, add, or remove franchises at any time.

7. Affiliate Links

The App contains links to Amazon product pages via the Amazon Associates programme. We earn a commission on qualifying purchases made through these links. These links are provided for your convenience and do not imply endorsement. Amazon's own terms and privacy policy apply to any purchases you make.

8. Disclaimers

• The App is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
• Rankings and ratings are based on user votes and algorithmic calculations — they represent personal preferences, not objective quality assessments.

9. Limitation of Liability

To the maximum extent permitted by law, FanSwype shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data or rankings.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the App.

11. Termination

We may suspend or terminate your access to the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.
